General Terms and Conditions of Sale Sham Delights
- Applicability: These
General Terms and Conditions of Sale apply to all transactions with Sham
Delights. Deviations only apply if agreed upon in advance, in writing and
explicitly, without prejudice to the other provisions. Accepting an offer
or placing an order implies that the customer acknowledges and accepts
these conditions.
- Offers
and Prices: Offers and prices are indicative and without
obligation. Sham Delights accepts no responsibility for typographical or
printing errors and reserves the right to immediately pass on cost price
changes, exchange rate fluctuations or legal regulations. All applicable
prices include VAT and exclude order and shipping costs, any taxes or
other levies, unless otherwise stated or agreed in writing.
- Orders: The
agreement is concluded by placing an order via the website, telephone or
e-mail. Sham Delights reserves the right to refuse orders or to impose
conditions, such as requesting an advance payment, without stating a
reason.
- Shipping
and Delivery: Orders placed before 19:00 will be delivered the
next business day (except Saturday, Sunday, public holidays and
promotional days). Delivery times are usually between 17:00 and 22:30. A
Track and Trace link will be provided to follow the delivery.
- Offer: The
offer includes an accurate description of the products offered. Images on
the product pages are a true representation. Obvious mistakes or errors in
the offer do not bind Sham Delights. Each offer contains sufficient
information to make clear which rights and obligations are associated with
the acceptance.
- Images
and Specifications: Images and specifications on the website are
for information purposes only and may differ from the products supplied.
This does not justify compensation.
- Payment: An
agreed order via the webshop at www.shamdelights.nl is
paid immediately via iDeal.
- Complaints
and Warranty: The term for complaints is limited to the
aforementioned terms. Sham Delights has the right to replace defective
products or to refund the invoice value.
- Transfer
of Risk and Ownership: Risk passes to the customer upon delivery,
but ownership does not pass until full payment has been made.
- Right
of withdrawal: The right of withdrawal is excluded due to the
short shelf life and customization of the product. After successful
payment, the sale is final.
- Liability: Sham
Delights is not liable for damages, unless intent or gross negligence is
proven. Sham Delights is not responsible for information from third
parties.
- Additional
or Deviating Provisions: Additional or deviating provisions must
be recorded in writing and may not be to the detriment of the consumer.
- Disputes: Only
Dutch law applies to agreements between Sham Delights and the consumer.
- Rights: All
contacts and transactions with Sham Delights are subject to all rights and
claims of Sham Delights. No part of Sham Delights’s publications or issues
may be reproduced without the prior written consent of Sham Delights.
- Complaints: The
customer is obliged to inspect the goods immediately after collection or
delivery. Complaints must be submitted to Sham Delights in writing or by
e-mail within one day after the time of delivery of the goods, with a
specified statement of the nature of the complaints.
